Hereinafter referred to as Brightly. The person making the booking is hereinafter referred to as the Participant or the Buyer.

2. Brightly's service

Brightly provides a matching and table booking service for people who want to meet new people in real life. Brightly puts Participants together in small groups and books a table for each group at a restaurant, café, bar or other place run by a third party (the Venue).

Brightly does not run the Venue and does not sell the Venue's food, drinks or other services. The Venue provides those directly to the Participant.

Formats offered by Brightly may include:

  • Dinner with Strangers;
  • shared dinners;
  • BBQ evenings;
  • listening bar events;
  • tastings;
  • masterclasses;
  • coffee meetups;
  • walks;
  • other social formats offered on the website.

If a specific offer is a ticket to an event run by Brightly or by a third party, the offer says so, and its description sets out what the price includes.

The date, time, city, price, language and other essential terms of a specific booking are stated before the booking is made.

3. Dinner with Strangers

Dinner with Strangers is a Brightly matching format. Brightly puts together a table of people who usually do not know each other beforehand and books that table at a Venue chosen by Brightly.

The Participant usually books a place individually.

Brightly may use information the Participant provides during registration or in the survey, including:

  • age group;
  • language;
  • interests;
  • social preferences;
  • preferred group size;
  • availability;
  • other answers given voluntarily,

to form balanced groups of participants and to choose a suitable Venue.

Brightly does not guarantee a specific table composition, the participation of a specific person, mutual compatibility, the forming of friendships or any other specific social outcome.

4. Participants' age

Unless the description of a specific event states otherwise, Brightly events are intended for persons aged 18 and over.

By making a booking, the Participant confirms that they have reached the required minimum age.

If necessary, Brightly or the venue may ask to see an identity document.

5. Making a booking

To book a place at a Brightly event, the Participant may need to:

  1. fill in the Brightly survey;
  2. provide their first name and surname;
  3. provide their email address;
  4. provide their phone number;
  5. choose, or receive, a specific event offer;
  6. read the event information;
  7. read these Distance Contract Terms and the Privacy Policy;
  8. make the relevant payment.

The Participant is responsible for the accuracy of the information provided.

6. Price

Unless a different price is stated in the offer for a specific event, the Brightly booking fee is EUR 5.00.

It is a one off fee.

It is not a subscription, and the booking does not create automatic recurring payments.

The stated price is the final price for the consumer and includes applicable taxes, including VAT where applicable.

7. What the booking fee includes

Unless the description of a specific offer states otherwise, the Brightly booking fee is payment for Brightly's own matching and table booking service, which includes:

  • processing the Participant's booking;
  • matching the Participant with other Participants and forming the group or table;
  • choosing the Venue and booking the table there;
  • sending the Participant the Venue, the time and other necessary information.

Brightly provides this service in its own name. The booking fee is not payment for the Venue's food, drinks or other services, and Brightly does not sell them on the Venue's behalf.

Unless the offer for a specific booking clearly states otherwise, food, drinks, the restaurant bill, transport and other purchases at the Venue are not included in the Brightly booking fee.

The Participant pays for such additional costs themselves, directly to the Venue.

8. Payments

Payments are made on Shopify's secure checkout page and are processed by the payment service providers available there.

Brightly does not store full payment card details.

A booking is considered paid only after the payment has been successfully confirmed.

The final amount payable is shown to the Participant on the payment page before the purchase is made.

9. Conclusion of the distance contract

The distance contract is concluded electronically.

The order button uses wording that clearly indicates that pressing it creates an obligation to pay, for example: “Pay €5 and hold my seat” (“Maksāt 5 € un rezervēt vietu”) or other equally clear wording.

The contract is considered concluded after:

  1. the Participant has submitted the information required for the booking;
  2. the Participant has been given the essential information about the event;
  3. the Participant has been given the opportunity to read these terms;
  4. the Participant has placed an order with an obligation to pay;
  5. the payment has been successfully confirmed.

10. Venue

For some Brightly events the exact venue may not be revealed at the time of booking, if this is part of the event concept.

In that case the Participant is informed of this before booking.

The exact venue is sent to the contact details provided by the Participant a reasonable time before the event, usually no later than one day before it takes place, unless the description of the specific event states otherwise.

11. Event time and arrival

The Participant must arrive at the place and time stated in the event information.

If the Participant is significantly late, Brightly cannot guarantee that they will be able to take full part in the group or table already formed.

The Participant is asked to let Brightly know in good time if they will be significantly late.

12. Right of withdrawal

A Brightly booking relates to an entertainment (leisure) service provided on a specific date or within a specific period.

Under subparagraph 22.12 of Cabinet of Ministers Regulation No. 255 of 20 May 2014 “Regulations on Distance Contracts”, a consumer cannot use the 14 day right of withdrawal for a contract for entertainment services where the service provider undertakes to provide the service on a specific date or within a specific period.

Therefore, when buying a booking for a Brightly event on a specific date, the Participant has no automatic right to withdraw from the purchase within 14 days merely because they have changed their mind.

This clause does not limit any other rights the Participant has under the law, including where Brightly does not provide the service in accordance with the contract.

13. Cancellation by the Participant

If the Participant cannot come to the event, they are asked to let Brightly know as early as possible: info@brightlyagency.com.

Cancelling a booking, or not attending, for the Participant's personal reasons does not in itself give an automatic right to a refund of the booking fee paid.

If Brightly offers a more favourable cancellation or rescheduling arrangement for a specific event, it is stated in the event description.

14. Transferring a booking to another person

Because Brightly may use a specific Participant's survey answers to form the group, a booking may not automatically be transferred to another person.

If the Participant wishes to pass their place to someone else, they must contact Brightly first.

Brightly will try to find a solution where possible, but cannot guarantee that a change of participant will be possible.

15. Cancellation of the event by Brightly

If Brightly cancels the event and does not offer the Participant an acceptable equivalent replacement event, the Participant is refunded the amount paid for the relevant Brightly booking.

The refund is usually made to the original means of payment, unless otherwise agreed.

16. Change of event date or time

If Brightly significantly changes the date or time of the event and the Participant cannot attend at the new time, Brightly offers:

  • a place at another suitable Brightly event; or
  • a refund of the amount paid for the relevant booking.

Minor organisational changes do not in themselves give an automatic right to a refund.

17. Change of venue

Brightly may change the venue for justified organisational reasons.

If the new venue is in the same city and does not significantly change the nature of the event, the change is not considered a cancellation of the event.

Brightly informs the Participant of significant changes as early as possible.

18. Conduct and safety

Brightly aims to provide a respectful and safe environment.

The following are not tolerated at events:

  • violence or threats of violence;
  • sexual harassment;
  • discriminatory or degrading behaviour;
  • aggressive behaviour;
  • deliberately ignoring other Participants' personal boundaries;
  • breaking the venue's safety rules.

Brightly or a representative of the venue may ask a Participant to leave the event if their behaviour creates a justified safety risk or significantly disturbs other Participants.

In the case of a serious breach, Brightly may also refuse that person's participation in future events.

19. Alcohol

If the event takes place at a venue where alcoholic drinks are sold, their sale and serving are the responsibility of the venue in accordance with the law.

The Participant is responsible for their own alcohol consumption.

Unless an offer clearly states otherwise, alcoholic drinks are not included in the Brightly booking fee.

20. Photography and filming

Photos or video may be taken at Brightly events.

Personal data, including identifiable photos and videos, are processed in accordance with Brightly's Privacy Policy and applicable data protection law.

If the Participant does not wish to be photographed or filmed, they are asked to tell Brightly before the event or when it starts.

Buying a booking does not in itself mean unlimited consent to the use of the person's image in advertising.

21. Processing of personal data

Brightly may process:

  • first name and surname;
  • email address;
  • phone number;
  • booking information;
  • payment status and payment identifiers;
  • answers given in the Brightly survey;
  • the event chosen or assigned;
  • other information the Participant provides voluntarily.

Detailed information about the processing of personal data, the recipients of the data, retention periods and the Participant's rights is given in Brightly's Privacy Policy.

22. Forming groups of participants

Brightly may use the information Participants provide to form groups, taking practical and social factors into account.

The group forming Brightly uses is not a psychological diagnosis, a medical assessment or a guarantee that people will be compatible.

Brightly does not guarantee:

  • the participation of specific people;
  • that all Participants who booked will come;
  • a specific group composition, unless this has been clearly promised;
  • that friendships or other relationships will form;
  • a specific social outcome of the event.

23. Participant's obligations

The Participant is responsible for:

  • providing true contact information;
  • checking the date and time of the event;
  • arriving on time;
  • looking after their personal belongings;
  • following the venue's rules;
  • treating other Participants and staff with respect.

Brightly's liability is not excluded or limited in cases where such exclusion or limitation is not permitted under the laws of the Republic of Latvia.

24. Third party services

Brightly events may take place in restaurants, bars, cafés, studios or other places run by third parties.

If the Participant separately buys at such a place:

  • food;
  • drinks;
  • transport;
  • other additional services or goods,

the transaction may be concluded directly between the Participant and the third party.

Brightly is not liable for goods or services sold separately by a third party, except where, under the offer for the specific event, Brightly itself is the provider of the relevant service.

25. Complaints

The Participant may send questions or complaints about the service provided by Brightly to:

SIA “Brightly Agency”
Valkas iela 1A, Rīga, LV-1010
Email: info@brightlyagency.com
Phone: +371 25 741 869

A complaint should preferably include:

  • first name and surname;
  • contact information;
  • the name and date of the event;
  • the booking reference, if there is one;
  • a description of the problem;
  • the solution you would like.

Brightly handles complaints in accordance with the procedure set out in law.

26. Consumer rights and dispute resolution

This distance contract is governed by the laws of the Republic of Latvia.

In the event of a dispute, the Parties first try to reach an agreement between themselves.

If no agreement can be reached, the consumer may use the consumer protection and out of court dispute resolution options provided by law, including, where applicable, applying to the Consumer Rights Protection Centre (Patērētāju tiesību aizsardzības centrs).

These terms do not limit the mandatory rights granted to consumers by law.

27. Confirmation of the contract

Within a reasonable time after the distance contract is concluded, and at the latest before the provision of the service begins, Brightly gives the Participant confirmation of the contract on a durable medium, for example by sending it to the email address the Participant provided.

The confirmation may state:

  • the event purchased;
  • the price;
  • confirmation of payment;
  • the date and time of the event;
  • the booking number;
  • the applicable distance contract terms.

28. Changes to these terms

Brightly may update these terms.

A specific purchase is governed by the version of the terms in force at the time the booking was made.

After the contract is concluded, a newer version of the terms does not automatically replace the version that applies to that purchase, unless the Parties have agreed otherwise or the law requires it.

29. Final provisions

If any provision of these terms becomes invalid or unenforceable, this does not affect the validity of the remaining provisions.

The legal relationship between Brightly and the Participant is governed by the laws of the Republic of Latvia.
